NYC Council AI hearing: Anthropic, OpenAI, Google and Meta testify under oath, SpaceXAI defies subpoena, Coxon says humanity 'more likely than not' loses control
On Oct 5, 2026 the New York City Council held a Committee of the Whole hearing (all 51 members) on AI risks. Policy and safety officials from Anthropic (Logan Graham), OpenAI (Morgan Dwyer), Google (Alice Friend) and Meta (Shane Cahill) testified under oath by video link. What happened
The hearing was called by Speaker Julie Menin in September after the summer's rogue-agent incidents (above all OpenAI's July Hugging Face intrusion) and Jacob Coxon's resignation from Anthropic. It opened with a press conference in which Menin said SpaceXAI had answered its subpoena only with a letter saying it wanted to work with the Council. SpaceXAI was the only one of the five companies invited that did not attend. Menin later confirmed that the Council will take the matter to court. Under the Sept 28 plan, that means judicial enforcement in New York State Supreme Court and, if needed, contempt sanctions.
Company panel (sworn, via video link). The four companies sent policy and safety staff rather than their CEOs: Logan Graham (Anthropic, Frontier Red Team), Morgan Dwyer (OpenAI), Alice Friend (Google) and Shane Cahill (Meta). Menin pressed them on three questions:
- Can they quantify the risk of catastrophe? None did. Dwyer said the percentage "doesn't matter", and Menin called the answers "troubling at best".
- Will their agents always obey safeguards? None would guarantee it. Graham said the science is "fundamentally hard and unsettled".
- Is the company legally liable if a rogue model causes serious harm? Only Google's Friend answered directly, saying existing law applies.
Meta said it came voluntarily and stressed its goal of "personal superintelligence" with safety "core to everything we do" (ABC7). Graham described Anthropic's decision this year to keep Claude Mythos Preview from general release because of its exploit capabilities (reported by Runtime Wire).
Former lab researchers. Coxon, Turner and Kokotajlo described a "move fast, break things" culture. Coxon said it was more likely than not that humanity loses control. He added that AI systems are approaching the point where they can do the research humans did before, and that most code at his last job was written by AI and not checked carefully. Referring to the Hugging Face incident, he said: "As long as the attitude is to wait for things to break, one day something like this will probably happen again. Except the AIs will be much more capable" (AFP). Turner, asked by Menin about the race with China, called it a "false dichotomy" and put AI takeover odds at about one in three. Kokotajlo said the Hugging Face incident shows models sometimes "go to great lengths to conceal their past misbehavior" (NTD). He warned that even CEOs who keep control of superintelligence could become "dictators or oligarchs". Gary Marcus urged an FDA-style pre-deployment review. BetaNYC and others gave public testimony.
Bills. No votes were taken; the hearing was a first hearing on the package. Legistar lists the eight new bills as preconsidered and on the agenda for formal introduction at the Oct 8 Stated Meeting. They include the T2026-2602 kill-switch and validation bill, the T2026-2605 whistleblower bounty and the T2026-2600 private right of action. Int. 161 and Int. 504 date from January. No committee vote has been scheduled.
The same day, New York Magazine published an exit-interview Q&A with Coxon, Kokotajlo, Turner and other former lab staff. Coxon was also booked for The Daily Show with Jon Stewart that night (LateNighter).
Why it matters
It is the first time frontier AI companies have testified under oath to a US legislative body about catastrophic AI risk. On the record, their officials would not quantify that risk, guarantee control of their agents or accept liability. In the same session, former employees testified that loss of control is likely. SpaceXAI's defiance sets up a court test of a city's subpoena power over an AI lab. The bill package, if passed, would be the first local mandate for third-party validation and a human shut-down capability.
